PitchLift, Inc. ("PitchLift", "we", "us", or "our") is committed to protecting the privacy of personal information (i.e., any information relating to an identified or identifiable natural person) who visit the pitchlift.co website (the “Site”) as well as being fair and transparent in the collection and use of your data. Amendments to this Privacy Policy will be posted to the Site and will be effective when posted. Your continued use of the Site following the posting of any amendment to this Privacy Policy shall constitute your acceptance of such amendment.

Your Consent

You might fill out a contact form on the Site and provide your name, email address, as well as any additional information you may provide us in the message box. By providing personal information to us, you voluntarily consent to the collection, use and disclosure of such personal information as specified in this Privacy Policy. Without such information, we could not provide you with our services. The legal basis for our processing of personal information are primarily that the processing is necessary for providing our services or answer to your request (i.e. for the performance of a contract between you and us), and that the processing is carried out in our legitimate interests, which are further explained below. Without limiting the foregoing, we may on occasion ask you to consent when we collect, use, or disclose your personal information in specific circumstances.

Data We Collect About You

We collect two types of data: ‍

Personal Data. We collect information by which you may be personally identified, such as your name, email address, business name, or phone number, through the contact form on our Site (“personal data”). This information is only collected when you voluntarily provide it and it is necessary to contact you.

Usage Data. We also collect information about your use of the Site, which does not identify you personally. This information includes things such as your operating system, browser, network, device, web pages you visited prior to coming to this website, and the location from which you accessed the Site. This information may also include details about your use of this website, including your access times, the time you spent on the Site, and the pages on our Site that you visited (“usage data”). We share this information with Squarespace and Google Analytics, our website analytics providers, to learn about site traffic and activity. The Site uses cookies and similar technologies, which are small files or pieces of text that download to a device when a visitor accesses a website or app. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Site.

How We Use Personal Data

Any information we collect and store directly relating to you is only collected when you contact us. This data is used to enable us to provide our services to you. We may use this information for the following purposes:

  • To communicate with you, including providing you with information requested from us about our services.

  • To meet our contractual commitments to you.

  • To provide the Site to you and to other users.

  • To monitor traffic patterns and gauge popularity of different features of the Site.

How We Disclose Personal Data

We do not sell or rent Personal Data to marketers or unaffiliated third parties. We sometimes share your Personal Data with trusted entities, as outlined below, for a business purpose.

We currently use the following service providers:

  • Website hosting provided by Squarespace (see their Privacy Policy).

  • Contact form provided by HubSpot (see their Privacy Policy).

  • Call scheduling provided by Calendly (see their Privacy Policy).

  • Extra web analytics provided by Google Analytics (see their Privacy Policy).

  • Credit card processing of online invoices is provided by QuickBooks (see their Privacy Policy).

  • Email list services provided by Campaign Monitor (see their Privacy Policy).

  • Document/file hosting is provided by Dropbox (see their Privacy Policy).

  • Project management provided by Airtable (see their Privacy Policy).

  • Internal communication is made via Google Workspace email (see their Privacy Policy), Apple iMessage (see their Privacy Policy), Skype (see their Privacy Policy), and Zoom (see their Privacy Policy). Customer information may pass through these services as working processes occur.

We take reasonable measures to ensure that these third parties provide sufficient guarantees to implement appropriate technical and organizational measures. We do not authorize the third parties to disclose your personal information to unauthorized parties or to use your personal information for their direct marketing purposes. Our employees, consultants, contractors, and partners may have access to our customer information or the systems storing it as part of and solely for the purposes of performing their jobs, or within the scope of their agreements with us. In all cases, we use reasonable efforts to ensure that your Personal Data, as part of our confidential business information, is protected under contracts with such persons.

Additionally, we may use and disclose your information when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our products and services; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. In addition, we may transfer your personal information and other information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets.

Storage of Personal Data

Your Personal Data may be stored and processed in any country in which we engage third party service providers, notably in the United States. By using the Site, you consent to the transfer of information to countries outside your country of residence, which may have different data protection rules than in your country. While such information is outside of the United States, it is subject to the laws of the country in which it is held, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. However, our practices regarding your personal information will at all times continue to be governed by this Privacy Policy and, if applicable, we will comply with the General Data Protection Regulation (“GDPR”) requirements providing adequate protection for the transfer of personal information from the EU/EEA to third country, notably by entering into standard contractual clauses.

Age of Consent

We do not knowingly provide the Site to and will not knowingly collect the personal information from anyone under the age of consent. If you live in a country in the EU/EEA, you must be at least 16 years old to use the Site or such greater age required in your country to register for or use the Site. If you live in any other country except those in the EU/EEA, you must be at least 13 years old to use the Site or such greater age required in your country to register for or use the Site. If you are under 13, do not use or provide any information to, on or through the Site, make any purchases through the Site, use any of the interactive or public comment features, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. In addition to being of the minimum required age to use the Site under applicable law, if you are not old enough to have authority to agree to our Privacy Policy in your country, your parent or guardian must agree to our Privacy Policy on your behalf. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Opting-out of communications

If you no longer want to receive marketing-related emails from us, you may opt-out via the unsubscribe link included in such emails or by changing your notification settings on our email service provider's website. Please note that even if you unsubscribe or opt-out of receiving marketing-related emails from us, we may still send you important service related communications.

Rights to Your Information

On written request and subject to proof of identity, you may access the personal information that we hold, used or communicated and ask that any necessary corrections be made, where applicable, as authorized or required by law. However, to make sure that the personal information we maintain about you is accurate and up to date, please inform us immediately of any change in your personal information by mail or email.

Depending on your location and subject to applicable law, you may be entitled to additional rights, including:

  • to be provided with a copy of your Personal Data held by us;

  • to request that we rectify or update your Personal Data that is inaccurate, incomplete or outdated;

  • to request that erase your Personal Data in certain circumstances provided by law;

  • to request that we restrict the processing of your Personal Data (while we verify or investigate your concerns with this information, for example);

  • to object to the further processing of your Personal Data, including the right to object to marketing; and,

  • to request that your provided Personal Data be moved to a third party.

You also have the right to lodge a complaint with the relevant data protection authority.

The PitchLift website or our services may provide you with access to other websites and services. These other websites and services operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk and subject to their own privacy policies.

Security

We use commercially reasonable efforts to ensure that Personal Data is secure and to prevent it being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us.

Data retention

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. We may change this Privacy Policy from time to time. Any changes we make to our Privacy Policy in the future will be posted on this page.
